Our Intellectual Property practice focuses on the protection, enhancement and enforcement of our clients’ intellectual property (IP) rights. The firm’s Intellectual Property Practice Group counsels a wide variety of clients, ranging from individuals, small start-up or non-profit entities to large national and multi-national corporations and research institutions such as universities.  The IP protection areas for which we provide service include:

  • Obtaining patents
  • Prosecution of trademark and service mark applications
  • Protection of trade secrets
  • Registration of copyrights
  • Licensing of or otherwise transferring intellectual property, including technology transfer
  • Performing IP due diligence in support of mergers and acquisitions or other transactions including IP
  • Litigation concerning trademark and trade dress infringement, misappropriation of trade secrets, unfair competition, and patent infringement.

Our practice is diverse nationally and internationally with clients based throughout the United States and in a number of countries.  We also have close associations with counsel located elsewhere, within the U.S. as well as in several other countries, to bring world-wide protection to our clients as they may so desire.

The principal attorneys in the Intellectual Property Group are: Peter B. Scull and K Kalan with a combined almost 20 years of legal experience.  Both Peter and K are registered to practice before the U.S. Patent and Trademark Office as well as being licensed in Colorado, Arizona (Peter) and California (K).

Because intellectual property issues often interrelate with other aspects of a client’s business, the Intellectual Property Practice Group draws on the experience and resources of our securities, tax, employment, and litigation practice groups to provide the client with appropriate advice and to achieve the best results in each case.

Fran Cetrulo, Larry Martinez, and Gene Sprague are prominent attorneys involved in this sort of interrelation with intellectual property matters having combined experience in this expanding practice area of over 35 years.
